These Terms of Use ("Terms") apply to https://newbraunfels.nolisvite.com/, the Noli's Vite New Braunfels customer portal, online forms, messages, notifications, and related website services. By using these services, you agree to these Terms. If you do not agree, please do not use them.

1. Website Information

We try to keep menus, prices, hours, specials, events, images, descriptions, and availability accurate. Information may change and occasional errors may occur. Current in-restaurant information and direct written confirmation control when website content conflicts with actual availability or an accepted arrangement.

2. Reservations

• A reservation form is a request and does not guarantee a table until confirmed.
• We may contact you to confirm details, offer another time, modify, or decline a request.
• Any cancellation, deposit, large-party, seating, or late-arrival terms provided during confirmation apply to that reservation.
• You are responsible for providing accurate contact information and notifying us when plans change.

3. Private Parties and Catering

Party and catering submissions are inquiries only. Pricing, menus, capacity, deposits, minimums, staffing, delivery, setup, service charges, taxes, cancellation terms, and other details are not binding until included in a written confirmation, proposal, or agreement accepted by the parties.

4. Online Ordering and Payments

Online orders and payments may be handled by a third-party provider. Its terms, privacy policy, refund rules, fees, and availability apply to transactions made through that service. We may assist with restaurant-specific order concerns, but we do not control the availability of a third-party platform.

5. Menus, Allergies, and Alcohol

• Ingredients, preparation methods, portions, prices, and availability may change.
• Tell restaurant staff about allergies or dietary needs before ordering. Website descriptions do not guarantee that an item is free from allergens or cross-contact.
• Food images are illustrative and may not exactly match the item served.
• Alcohol is served only to eligible guests and may require valid identification. We may refuse service as required by law or safety policy.

6. Customer Accounts and Secure Links

Creating a customer account is optional. Accounts are available for guests who want a faster way to track and manage inquiries and submit new requests. You can always call or email us to make, change, or cancel a reservation or inquiry without an account.

• Provide accurate information and protect your password, email account, devices, and private links. Portal profile details may be used to prefill reservation and inquiry forms while you are signed in.
• Do not access another person's account, inquiry, files, or messages.
• Private or time-limited links may expire or stop working after use.
• Customer edit requests are requests only. Changes are not effective until authorized staff approves them, and we may approve, reject, or ask for clarification.
• We may suspend access when reasonably necessary to protect customers, staff, or the website.
• Tell us promptly if you believe your account or private link has been used without permission.

7. Messages, Files, and Job Applications

You keep ownership of content you submit. You allow us to store, review, transmit, and use it as reasonably necessary to respond to your request, provide restaurant services, evaluate an application, maintain records, and protect the website.

Do not submit unlawful, threatening, deceptive, infringing, malicious, or unrelated content. Do not upload files designed to damage systems or bypass security. We may reject or remove unsafe content.

A job application does not guarantee review, an interview, employment, compensation, or a response. Employment, if offered, is governed by separate documents and applicable law.

8. Email and Text Messages

Service-related messages

When you submit a form or use an account, you authorize us to contact you about that request, including confirmations, questions, replies, status updates, edit-request approvals or rejections, security notices, and account actions.

Marketing email

Marketing emails will identify the sender and provide a way to unsubscribe. Unsubscribing from marketing does not stop necessary messages about an active request or account.

Marketing text messages

• When you separately opt in, you consent to receive recurring marketing texts from Noli's Vite about specials, events, and offers at the number you provide.
• Consent is not required to purchase food, make a reservation, submit an inquiry, or apply for a job.
• Message frequency varies. Message and data rates may apply.
• Reply STOP to opt out or contact us. Reply HELP for help. We may send one non-marketing message confirming your opt-out.
• You confirm that you are the account holder or have permission to use the mobile number provided.
• Message delivery is not guaranteed, and mobile carriers are not responsible for delayed or undelivered messages.

9. Promotions, Specials, and Events

Promotions and events may have dates, eligibility rules, exclusions, limits, and availability requirements. Unless stated otherwise, offers cannot be combined, have no cash value, and may be changed, postponed, or ended where permitted by law.

10. Acceptable Use

Do not misuse the website or portal. This includes attempting unauthorized access, submitting spam or false information, interfering with service, scraping private information, impersonating another person, introducing malicious code, or using the services for unlawful or abusive activity.

11. Intellectual Property

Website content, branding, menus, photographs, graphics, and software are owned by Noli's Vite or used with permission. You may view and print reasonable portions for personal, noncommercial use. No other license is granted.

12. Third-Party Services

Links and embedded features may be operated by ordering providers, Google, social networks, calendar providers, media hosts, and other third parties. We do not control their content, availability, security, or policies. Your use of those services is governed by their terms.

13. Disclaimers and Liability

To the extent permitted by law, the website and portal are provided "as is" and "as available." We do not promise uninterrupted, error-free, or completely secure service. We are not responsible for indirect or consequential losses caused by website unavailability, third-party services, or misuse outside our reasonable control. Nothing in these Terms limits rights or remedies that cannot legally be waived.

14. Changes, Governing Law, and Contact

We may update these Terms by posting a revised version and changing the effective date. If any provision is unenforceable, the remaining provisions continue to apply. These Terms are governed by Texas law, and disputes may be brought in a court with proper jurisdiction unless applicable law requires otherwise.
